MOWER NOISE WAS 'DEAFENING' Gardener sues former employer for hearing loss
A gardener, Clifford Sayers, is suing his former employer Baroness Chelwood, claiming he suffered “noise-induced deafness” as a result of years working as a gardener and forester. He alleges he is blighted by ringing in his ears from using chain saws, lawnmowers and other power tools while working on the 200-acre estate of Lord and Lady Chelwood in East Sussex. Lord Chelwood was the former MP, Tufton Beamish, who died in 1989.
The incessant noise made it too difficult to watch television, or even make conversation with his wife, the Court of Appeal heard. Mr Sayers, who was employed by the couple from 1981 to 2000, claims he suffered a 45 per cent reduction in his overall hearing and is seeking about £25,000 in damages.

Mr Sayers had already attempted to sue for compensation, but had his claim struck out last year by the county court judge, who claimed he had left it too late. His case was “time-barred” because he did not begin proceedings until July 2008, the judge ruled.
Mr Sayers had been told in 2005 that his hearing loss could be age-related and had not realised until years after leaving Lady Chelwood’s employ that he might have a case against her, said the barrister.
Lady Justice Arden, Lord Justice Jackson and Lord Justice Kitchin reserved their decision on Mr Sayers’s appeal until a later date.
